Artikel 8 der EU-Grundrechte-Charta sch\u00fctzt personenbezogene Daten.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Recht auf informationelle Selbstbestimmung<\/h2>\n\n\n\n<p>Das Bundesverfassungsgericht formuliert 1983 einen &#8222;Schutz des Einzelnen gegen unbegrenzte Erhebung, Speicherung, Verwendung und Weitergabe seiner pers\u00f6nlichen Daten&#8220; (Leitsatz 1).<\/p>\n\n\n\n<p>&#8222;Das Grundrecht gew\u00e4hrleistet insoweit die Befugnis des Einzelnen, grunds\u00e4tzlich selbst \u00fcber die Preisgabe und Verwendung seiner pers\u00f6nlichen Daten zu bestimmen. Einschr\u00e4nkungen dieses Rechts auf &#8222;informationelle Selbstbestimmung&#8220; sind nur im \u00fcberwiegenden Allgemeininteresse zul\u00e4ssig. Sie bed\u00fcrfen einer verfassungsgem\u00e4\u00dfen gesetzlichen Grundlage, die dem rechtsstaatlichen Gebot der Normenklarheit entsprechen muss.&#8220; (Leitsatz 1, 2)<\/p>\n\n\n\n<p>Das Bundesverfassungsgericht leitet dieses Recht auf informationelle Sebstbestimmung ab aus Art. 2 Abs. 1 (allg. Handlungsfreiheit) in Verbindung mit Art. 1 Abs. 1 Grundgesetz (Menschenw\u00fcrde).<\/p>\n\n\n\n<p>Bundesverfassungsgericht, &#8218;Volksz\u00e4hlungs-Urteil&#8216; vom 15.12.1983<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">EU-Grundrechte-Charta Artikel 8 &#8222;Schutz personenbezogener Daten&#8220;<\/h2>\n\n\n\n<p>(1) Jede Person hat das Recht auf Schutz der sie betreffenden personenbezogenen Daten.<\/p>\n\n\n\n<p>(2) Diese Daten d\u00fcrfen nur nach Treu und Glauben f\u00fcr festgelegte Zwecke und mit Einwilligung der betroffenen Person oder auf einer sonstigen gesetzlich geregelten legitimen Grundlage verarbeitet werden. Jede Person hat das Recht, Auskunft \u00fcber die sie betreffenden erhobenen Daten zu erhalten und die Berichtigung der Daten zu erwirken.<\/p>\n\n\n\n<p>(3) Die Einhaltung dieser Vorschriften wird von einer unabh\u00e4ngigen Stelle \u00fcberwacht.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>BVerfG, Urteil des Ersten Senats vom 15.
